General Terms and Conditions

The General Terms and Conditions of the FC OLIMPIJA d.o.o. website and shop are drawn up in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1), the Tax Invoice Validation Act (ZdavPR) and the Electronic Communications Act (ZEKom-1).

The General Terms and Conditions of Business determine the operation of the online shop of FC Olimpija d.o.o., the rights and obligations of the user and the shop, and regulate the business relationship between the provider and the buyer. The Buyer is bound by the General Terms and Conditions, which are valid at the time of purchase (placing an online order). The User is individually reminded of the General Terms and Conditions when placing an order and confirms his/her familiarity with them by placing the order.

By using the Website, the User acknowledges that he/she understands, accepts and agrees to all the provisions of these General Terms and Conditions and the Privacy and Data Protection Policy published on the Website.

These General Terms and Conditions, as well as the Privacy Policy, may be amended or supplemented at any time without notice or warning. By using the website after a change to this policy, the user confirms that he/she accepts the changes.

Defining terms

The tenderer is FC Olimpija d.o.o., Vojkova cesta 100, Ljubljana, 1000 Ljubljana, which operates an online shop on the website https://nkolimpija.si/ (hereinafter referred to as the Olimpija website).

User means a person who uses the Provider’s website and online shop, which operates at the following link: https://shop.nkolimpija.si/si/shop.html

The Buyer is the person who uses the Provider’s website and purchases in the system of the Olimpija Website of FCO, which operates on the website https://shop.nkolimpija.si/si/shop.html.

The Olimpija website is an information system for presenting news, players, matches and everything else related to the Olimpija football club and for selling products.

The General Terms and Conditions of Business deal with the operation of the provider, the rights of the buyer and the business relationship between the provider and the buyer.

Use of the website

The use of the Olimpija website is subject to these Terms of Use, including the applicable regulations of the Republic of Slovenia in this area.

By using the website, each user:

  • expressly agrees to the General Terms and Conditions of Use;
  • undertakes to use the website in a lawful manner;
  • undertakes not to use the Service for the purpose of publishing or promoting any content and/or advertisement that is contrary to applicable law and public policy and morality;
  • is responsible for knowledge of and compliance with the applicable regulations of the Republic of Slovenia relating to the use of the Olimpija Website;
  • will not distribute copyrighted content or content owned by another legal or natural person;
  • will not attempt to obtain, collect and/or store personal data of other users;
  • will not copy, store or transmit in any way all or part of the content of the Olimpija Website will not use computer codes, malicious programs or anything that could interfere with, disable or damage this service, the service provider or its software and hardware.

Accessibility of information

FCO undertakes to provide the following information to the Customer at all times:

  • the identity of the company (name and registered office, registration and tax number),
  • contact details that allow the user to communicate quickly and efficiently (email, phone),
  • the essential features of the goods or services (including after-sales service and guarantees),
  • product availability (every product offered on the website should be available within a reasonable time),
  • the terms of delivery of the product (method, place and date of delivery),
  • all prices must be clearly and unambiguously stated and it must be shown whether they already include taxes and transport costs,
  • method of payment and delivery,
  • the time validity of the offer,
  • the period within which the contract can still be withdrawn from and the conditions for withdrawal; and if and how much it will cost the buyer to return the product,
  • an explanation of the complaints procedure, including full details of the contact person or customer service,
  • functionality, including, where appropriate, measures in place for the technical protection of digital content,
  • information on the compatibility of the digital content with the hardware and software of which the undertaking is or should be aware,
  • the costs associated with the use of the means of communication, if different from the basic tariff,
  • the existence of codes of conduct and the accessibility of any codes of conduct.

Purchase procedure

Cart

On the Olimpija website, or its subpages, select the product and the desired quantity and click on the “Add to basket” button. For products with multiple options for size, colour, etc., select the size and colour (if applicable) and click on the “Add to basket” button.

If you click on the “Add to basket” button, a “basket” will open/appear on the right side of the screen. If you wish to continue shopping, click on the “Continue Shopping” button at the bottom and the “Basket” will close; this allows you to continue shopping in the online shop.

To remove a product from your shopping basket, you need to click on the “basket” icon and click on the “cross” next to each product or set the quantity of the product to 0 by clicking on the “-“. The shopping cart will be updated automatically.

To increase the quantity of an already selected product in your shopping basket, you need to click on the “basket” icon and increase the quantity of the selected product. To do this, click on the “+” button. The shopping cart will be updated automatically.

To continue shopping, click on the “Continue Shopping” button.

The “basket” icon allows you to view your product selection and shows you the partial amount of your order (excluding postage).

To complete your purchase, go through the following three steps. When you click on the “basket” icon, it will take you to the page of your selected products. To complete your purchase, click on the “checkout” button to select your payment method, confirm with the “continue” button, log in (if you are already a registered user) and fill in your personal details for delivery.

If you wish to complete your purchase and you have filled in your details, click on the “Continue” button and the system will take you to the last page of your purchase (purchase overview), where you confirm your purchase by clicking on “Confirm and pay”.

If you are buying tickets, please select the desired option in the menu (exact match, multi-ticket package, season ticket, etc.). On the next screen, select the desired sector in which you are selecting seats. You can choose from the seats highlighted in green. Once you have selected all the seats you want, you can choose the ticket variation, i.e. you can choose between ADULTS or CHILDREN. If you are buying a ticket for a person under 14 years of age you must choose the “CHILDREN” variation, if the person is older you must choose the “ADULT” variation. When you have finished making your selection, please confirm by clicking the “proceed to checkout” button.

For matches where the competent authority prescribes personalisation, it is necessary to manually enter the required information that is essential for entry into the stadium.

If you have a discount voucher, enter it in the box under “Add voucher”. If the voucher code is correct and active, you will see a green notification “Voucher code successfully added”. If the voucher code is not correct and/or not valid, you will see a red message “Invalid voucher code”.

Once you have successfully completed all the necessary information, proceed with the purchase by clicking on the “Continue Order” button.

If you want to go back to the seat selection, press the “Back to seat selection” button.

Checkout

To complete your order, click on the “proceed to checkout” button in the “shopping basket” and fill in all the necessary fields.

Delivery address: you must provide the requested contact details marked with an asterisk (first name, last name, country, address, city, postcode, e-mail address and telephone number), which we need to confirm and complete your order and to deliver your product.

Payment method: you can choose between several different payment methods indicated at the time of completion.

Vouchers: if the user has a valid discount voucher, they enter it in the relevant field and click on the “redeem voucher” button.

Order overview: this page displays the products that the user has added to their shopping basket while browsing the online shop.

Price: the price of each item, the postage cost and the total cost to be paid are displayed before the customer completes the order.

Order completion: the user can review the delivery details provided, the payment method chosen and the contents of the shopping basket. The user confirms the order by clicking on the “complete order” button.

If the order has been successfully completed, the website will display “Thank you. Your order has been accepted.”

If you buy tickets, you will receive them in the email registered with your account.

Purchase notification procedure

After placing an order, the customer receives an email notification that the order has been accepted.

FCO may call the Buyer on the contact telephone number or email address provided to verify the information or to ensure the accuracy of the delivery.

The purchase process for legal persons is exactly the same as for natural persons (described above), except that the company name and tax number must be entered at the end of the purchase.

Consumer’s right of withdrawal

For distance contracts, in accordance with Articles 43c and 43d of the Consumer Protection Act, the consumer has the right, within 14 days of receipt of the goods, to notify the company by email to shop@nkolimpija.si that he or she is withdrawing from the contract, without being required to give a reason for his or her decision.

The consumer must return the goods to the company no later than 14 days after the cancellation notice. The consumer shall return the goods to FC Olimpija d.o.o, Vojkova cesta 100, 1000 Ljubljana. If the goods ordered are personalised, withdrawal from the contract is not possible.

The only cost to the consumer of withdrawing from the contract is the direct cost of returning the goods (postage).

The consumer must return the product to the seller undamaged and in the same quantity, unless the product has been destroyed, spoiled, lost or reduced in quantity through no fault of the consumer (Article 43c(5) of the Consumer Protection Act).

When returning the goods, the consumer also sends the company the invoice for the goods, together with his/her personal details and the transaction account to which he/she wishes to receive the refund. The refund will be made within thirty days of receipt of the notice of withdrawal (this refund does not include the cost of returning the goods).

In the event of withdrawal from a contract where a promotional code or discount code has been used, these funds will be taken into account as a discount and will not be refunded to the user. Only the amount paid will be refunded to the user’s TRR and the promotional code will be returned to the user in the form of a new code. The gift voucher shall be considered as means of payment upon withdrawal and returned to the user as a gift voucher.

In the case of a ticket purchase, the customer does not have a right of withdrawal under Article 43(12) of the Consumer Protection Act (CPA) in the case of leisure services where the company undertakes to fulfil its obligation on a specific date or within a specific period of time. In view of the above-mentioned statutory exception, according to which the consumer does not have a right of withdrawal from the purchase of tickets, all orders for tickets are binding, irrespective of the method of ordering. Tickets for all NK Olimpija events purchased via the website www.shop.nkolimpija.si or at NK Olimpija’s point of sale or from intermediaries cannot be returned, exchanged or refunded.

In the event of cancellation, change of date or time of the event, the event organiser will be responsible for dealing with the situation and refunding the money in all cases. In the event of the above circumstances, NK Olimpija will inform ticket purchasers as soon as possible about the validity of tickets and refund options. The refund will only be issued in the event of cancellation of the event, otherwise the tickets will be valid for the rescheduled date or time of the event.

In the event of lost or stolen tickets, the purchaser is not entitled to reimbursement, replacements or replacement tickets.

It is the buyer’s responsibility to check the validity of the date, time and location of the event for which the ticket was purchased. Upon receipt of the ticket, the Buyer is obliged to check the ticket immediately and to immediately notify the Seller of any errors in the printout of the ticket (such as incorrect printout of the event, date, time and location of the event and incorrect indication of the selected seat); subsequent complaints will not be accepted.

Order from

The purchase contract between FCO and the Buyer is concluded on the Olimpija Website at the moment when FCO sends the Buyer the first e-mail confirming the Buyer’s order. From that moment on, all prices and other conditions are fixed and apply to both FCO and the Buyer.

The Purchase Contract (i.e. the first email notification of the status of the order) is stored electronically on FCO’s server and is available to consumers upon their written request.

Payment methods

The FCO website allows the following payment methods:

  • Credit and debit cards,
  • PayPal
  • TRR order

Delivery

The goods shall be prepared by the Supplier and the delivery service shall be carried out in accordance with the terms and conditions of GLS. The Buyer may specify a delivery address at the time of placing the order, which shall be binding on the Supplier. In these General Terms and Conditions, the Provider shall provide all the necessary information regarding the address to which the Buyer may turn in the event of a complaint.

If you order home delivery, you will also be notified of the delivery by the GLS delivery service via the means of communication you indicated when you placed your order. The delivery service will usually notify you of the delivery by means of a telephone message, which will also specify the estimated time of delivery and an e-mail address at which you can change the time of delivery or the method of collection.

Please note: These conditions apply only within the Republic of Slovenia.

If you have purchased tickets, they will be delivered to the email address you provided in the last step of the purchase process.

Delivery costs

The packaging and delivery costs for the purchase are EUR 5.30 if the delivery address is within Slovenia.

If the delivery address is in another EU country, the packaging and delivery charge is €15.9.

Please note: FCO would like to remind customers that the delivery service may incur a collection fee. For the latter, the buyer is referred to the current price list or general terms and conditions of GLS.

Packaging and delivery costs for third countries: negotiable.

Personal collection

Invoicing (under the Tax Invoice Certification Act)

Upon payment for the ordered products and upon delivery, FCO will also send the customer a physical invoice to the shipping address provided (the invoice is included in the package with the ordered products).

In case the buyer decides to collect the goods in person, he/she can collect the ordered goods after receiving the confirmation message by PREVIOUS CONVERSATION from Mon – Thu from 9.00 to 19.00 at the address Plečnikove arkade, Adamič-Lundrovo nabrežje 5, 1000 Ljubljana by:

The invoice breaks down; price, VAT, postage costs. It is the buyer’s responsibility to check the accuracy of the information before placing an order.

If you buy tickets with a credit card, you will receive an invoice to the email address you provided at the last step of the ticket purchase process. The invoice is sent together with the email containing the tickets.

Vouchers/Promotional codes

Promotional codes or vouchers offer various purchase benefits and are usually time-limited. You can find an active promotional code on our website, on the front page of an advertisement, in our e-newsletters or in other media.

Promotion codes cannot be exchanged for cash. The voucher is redeemable in full only. In the event that the purchase value is higher than the value of the voucher, the holder of the promotional code must pay the difference. The purchase value must be higher than the voucher value.

Use of Coupon/Promotion Code:

Select the product you want to buy and add it to your basket.

Choose your delivery method, specify your delivery address and select your payment method.

Enter the code in the “Promotional code or Coupon” field and confirm by clicking on the “redeem coupon” button.

When you enter the promotional code, the value of the gift vouchers is automatically deducted from the price of your order. If the amount of your order is higher than the value of the voucher, you pay the difference. You then place your order online.

Liability for material defects

The seller is liable for material defects in the goods at the time when the risk passed to the buyer, whether or not the seller was aware of them. The seller shall also be liable for those material defects which become apparent after the risk has passed to the buyer, if they are the result of a cause which existed before that time. Insignificant material defects shall be disregarded.

We will try to resolve any complaint as quickly as possible and, above all, in the best interests of the customer. Complaints about purchased goods are taken into account in accordance with the provisions of the Consumer Protection Act (CPA).

Security

FCO uses appropriate technological and organisational means to protect the transmission and storage of personal data and payments. For secure authorisations and credit card transactions, payments are made via the payment gateway of PAAZ d.o.o.

Credit card authorisations are carried out in real time, with instant verification of the data with the banks. Card data is not stored on FCO’s server.

Exceptional disclosure of personal data

The data collected and processed by FCO d.o.o. will only be disclosed if the Personal Data Protection Act so provides or in the good faith belief that such action is necessary for proceedings before courts or other public authorities.

Communication

FCO will only contact the User by means of distance communications if the User expressly consents to this. FCO will expressly respect the user’s wish not to receive advertising messages.

The advertisement emails will contain the following elements

  • they will be clearly and unambiguously identified as advertising messages,
  • the sender will be clearly visible,
  • various campaigns, promotions and other marketing techniques will be labelled as such,
  • a clear explanation of how to opt-out of receiving advertising messages.

Assessments, opinions and recommendations

Customer reviews, ratings and recommendations are part of the functionality of the online shop and are intended for the community of all users.

FCO allows any user of the online shop to write a review, which is further reviewed before final publication. FCO will not publish reviews or submissions that are in any way offensive, inappropriate, or that, in FCO’s sole discretion, do not provide a benefit to other users and visitors to the Website.

By submitting an opinion or comment, the user expressly agrees to the General Terms and Conditions and to the use of his/her opinion or comment and authorises the publication of the opinion or only part of it in all electronic and other media.

FCO has the right to use the content of an opinion or comment for an unlimited period of time and for any purpose that is in its commercial interest, including publication in advertisements or other marketing communications.

The author of the opinion also declares and warrants that he/she is the owner of the material and moral copyrights of the opinions and comments written and that he/she exclusively and indefinitely transfers these rights to FCO d.o.o.

Legal notice

FCO’s online shop and all information on it, such as images of items, graphics and video elements on the website are proprietary and may not be reproduced or used without the prior written permission of FCO.

Limitation of liability

FCO makes every effort to ensure that the information published on the website is up-to-date and correct. However, product characteristics, delivery times or prices may change so rapidly that FCO is sometimes unable to correct the information on the website. In such a case, FCO will inform the Customer of the changes and give the Customer the opportunity to withdraw from the contract or to exchange the product ordered.

Exclusion of liability

We reserve the right to disable or prevent access to the Website due to technical or other problems and maintenance, including disabling or impeding the use of the Online Shop.

In the event of technical problems with the website, we reserve the right to cancel orders placed and affected by the technical fault. In the event of cancellation, we will notify you as soon as possible and inform you of the next steps.

It is your responsibility to ensure that the equipment is properly protected before accessing and using the website.

The Buyer must ensure the appropriate security and confidentiality of the data used to log in to the Website.

Complaints and disputes

FCO complies with applicable European consumer protection legislation and makes every effort to fulfil its obligation to establish an effective complaints handling system and to identify a person whom the customer can contact by phone or email in case of problems.

The complaint should be submitted by email to: shop@nkolimpija.si. The complaint procedure is confidential. FCO will acknowledge receipt of the complaint within five working days, notify the customer of the time period for the complaint and keep the customer informed of the progress of the complaint.

The FCO recognises that a key feature of consumer litigation, at least as far as judicial resolution is concerned, is the disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle to a consumer not bringing a dispute before the courts. Therefore, the FCO makes every effort to resolve potential disputes amicably.

In the case of judicial dispute resolution, the court of the consumer’s domicile has jurisdiction.

Out-of-court settlement of consumer disputes (in accordance with Article 32 of the Consumer Dispute Resolution Act)

In accordance with the legal norms, we do not recognise any out-of-court consumer dispute resolution provider as competent to resolve a consumer dispute that a consumer may bring under the Act on the Out-of-Court Settlement of Consumer Disputes.

FCO, as a provider of goods and services online in Slovenia, publishes on its website an electronic link to the Online Consumer Dispute Resolution Platform (ODRP). The platform is available to consumers at https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=SL.

These rules are based on the Law on Out-of-Court Settlement of Consumer Disputes, Regulation (EU) No 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and amending Regulation (EC) No 2016/2004 and Directive 2009/22/EC.

Changes

The Provider may modify the existing General Terms and Conditions without prior notice. The User undertakes to check whether the terms and conditions of use have changed.

In the event that the user no longer agrees to the amended terms of use, the user must immediately stop using the Olimpija website. By accessing the website, you confirm that you agree to any changes and amendments.

Information on the compatibility of digital content with hardware and software

The asa.si website is built on the WordPress platform (WordPress™ 5.9.1). The average page load time is 3 seconds. The website is compatible with modern web browsers Firefox, Chrome, Internet Explorer, Safari, Edge, Android Browser, Opera, IOS, Maxthon and similar systems. Operation has been verified smoothly in modern networks of Telekom Slovenije, t-2 network, Siol, Amis, Telemach and other providers with appropriate and comparable technical equipment.
